英文摘要	周清林,西南政法大学民商法学院副教授，法学博士。; 【中文摘要】现行法律规定下的地权制度建立在身份的基础上，以社会保障作为其基本目标。如果身份及其背后的社会保障发生改变，那地权必将易主。新型城镇化下提出的优先将农业转移人口市民化的战略，定位于使身份中立化的价值倾向，尽力将基本公共服务的提供作为政府的责任而淡化二元结构下社会保障的不平等性，因而对传统的农村地权产生了严重的冲击。“带地入城”便是这一冲突的最直接体现。在农民工市民化这一特殊情景下，身份以及社会保障对地权的限定性已经无关紧要，允许农民带着地权入 城具有无可置疑的正当性。但若将农民能带入城的地权定性为纯粹的财产权，并不现实。现时代的地权制度改革不应该冒进，而应当在朝着财产权的方向上让历史去消化。因此，如今的地权制度应当处于过渡期，既要依存二元结构又要突破二元结构。在具体制度的构建上，需要重新对地权进行确权、扩大地权的流通渠道以及设立地权的有偿退出制度。 【Abstract】According to the current law, the system of rural land，with social security as its basic goal, rests on the rural status of its proprietors. The change of status will, of course, lead to the change of its proprietorship.Under the new-type urbanization, the strategy of the citizenization of migrant workers aims at bringing about the neutralization of rural status in relation to land proprietorship, and establishing the very function of the government as providing the basic public services ,so as to remedy the injustice of the social security under the dual structure .And this will ,no doubt, effect great impact on the current rural land system and finally dissociate the rural land from the status of peasants and social security .In this background, peasants should be well entitled to‘carrying land into city’. But if we are to see the land right of this type as a pure property right, it could be kind of absurd.The reformation of the rural land right should not progress too fast, instead, should step by step. We need first redefine the land right, then establish its circulating channel and construct the system of compensation for its waiver (“Exit”).
