英文摘要	许金约,福建省泉州市丰泽区人民检察院检察长。陈树斌,福建省泉州市丰泽区人民检察院公诉科副科长，刑法学硕士，首届全国检察调研骨干人才。; 【中文摘要】台湾地区认罪协商制度规制为起诉后发动、法官不得介入协商、采用轻罪原则且仅限于量刑协商，同时，有区分的采强制辩护主义。台湾地区理论与实务中一直存在先认罪还是先协商、法官可否参与协商程序等争议，目前虽然适用比例偏低，但潜在能力巨大。大陆在刑事政策、法律基础与外部压力上具备引入刑事协商程序的条件，应消减民众对辩诉交易的误解，合理确定认罪协商的适用范围，拓展认罪协商的多元主体，建立与完善相关的制度措施。刑事协商程序对于大陆检察官“化解办案风险”的价值远大于“烦琐的办案程序”，而法官消化案件，平稳化解矛盾的诉求与需求甚至高于案例难易本身。同时，应提倡重视犯罪嫌疑人妥速权，以提升司法文明指数。 【Abstract】The regulation about Taiwan's confession and consultation system have several characteristics, includes that initiated after prosecution, the justice cannot intervene, adopted the principle of misdemeanor, limited to sentence bargaining, adopted compulsory defense in some cases.The controversy existed in Taiwan's theory and practice is about plead guilty or consultation which is first and justice can participate in the consultation or not.The apply proportion is low for now, but the potential capacity is tremendous.Mainland got the qualification for introducing criminal consultation procedure in criminal policy, fundamental of law and external pressure.Mainland should dwindle people's misunderstanding of plea bargaining, determinate a reasonable scope of the criminal consultation procedure, expand multiple subject of criminal consultation procedure, establish a relevant and perfect institution measure.According to the mainland's director of public prosecution, the value of resolving the risk of handling the case about the criminal consultation procedure is worth more than the tedious working procedure. Furthermore the appeal and needs of solving cases and placidity resolve contradiction to justice even higher than the cases difficulty level. At the same time, the importance of the criminal suspect rights should be advocated, in order to enhance the judicial civilization index.
