| 英文摘要 | 周婧，中国社会科学院美国研究所副研究员，美国社会文化研究室副主任，法学博士。; 【中文摘要】2015年6月26日美国联邦最高法院宣告同性婚姻合法。这其实是一系列有关禁止或允许同性婚姻的斗争的结果。不仅宗教团体、同性恋者、民权组织、利益集团都参与到争论的过程，联邦和州的行政、立法和司法三大机构也卷入其中。而最高法院的判决虽然宣告了同性婚姻的胜利，却不意味着斗争的结束，反而引发了宗教人士、2016年大选的共和党参选人和保守州的强烈批评、反对和抵制。一旦保守州通过制定州法或者颁布行政命令给同性恋者领取结婚证设置严苛的条件，同性婚姻权将受到限制甚至剥夺，有关同性婚姻的分歧将更为严重，斗争可能愈演愈烈。这种分歧与斗争其实源于自由多元与传统精神之间的价值难题。 【Abstract】 June 26, 2015 United States Federal Supreme Court declared that same-sex marriage was legal. This is the consequence of a series of struggles about same-sex marriage, which not only religious groups, homosexuals,civil rights organizations, interest groups engage, but also federal and state administrative, legislative and judicial branches are involved. And the decision of the Supreme Court isn't the end of struggle, but led to strong criticism, opposition and resist of the religious people, 2016 Republican candidates and conservative states. If the conservative states set up harsh conditions on same-sex marriage, same-sex marriage rights will be restricted or even deprived. Then the divergence about same-sex marriage will be more serious and the struggle may be more intensified, which is derived from the value dilemma of freedom and traditional spirit. |
