英文摘要	马腾，厦门大学法学院副教授，法学博士。; 【中文摘要】“兼爱”乃墨家法哲学之根本精神，其义理经历墨翟初创——后学阐扬之发展历程。墨翟创议“兼爱”，于《墨子·兼爱》三篇可见其阐释“兼爱”之必要、可行及要求，展现其理论之基本特征。“墨辩”文本一方面运用逻辑方法将普遍性“兼爱”予以周延性陈述，彰显“兼爱”论对人类社会秩序之结合性、不可分割性、集体性的指陈，且以“超时空性”命题揭橥墨家法哲学之普世性价值。另一方面，鉴于墨者实践，后学更突出“兼爱”之一贯性与实践性，旨在使其高尚德性坐实于一种颇具经验品格的关于社会秩序与制度正义的思想。爱的纯粹性命题及“爱利一体”之论，赋予墨家法哲学平等、权利意蕴与浓厚的功利色彩，这是墨学于轴心时代独树一帜，于今日仍深富现实价值之所在。 【Abstract】At the core of Mohist legal philosophy, the idea of “Jian’ai” (universal love) was proposed by Mo Di and developed by his later followers. In the chapter of Jian’ai in Mo Zi, the necessity, feasibility and requirement of Jian’ai are elaborated in three sections and its theoretical basics are hence established. Mobian attempts to make a distributed development on the universality of “Jian’ai” with logics, emphasizing its reference to the integrity,inalienability and collectivity of social order, and revealing the universal values of Mohist legal philosophy with the proposition highlighting its transcendence of time and space. On the other hand, in light of Mohist practice, later scholars stress the coherence and practicality of “Jian’ai”, in the hope of placing such a virtuous and moral thinking on an empirical basis that features a concern about social discipline and institutional justice.The proposition of the pure nature of love and the argument of unity of love and interest suggest equality, the awareness of rights and strong utilitarianism, and that is why Mohism played a unique role in Chinese Axial Age and still has its realistic values to date.; 国家社科基金后期资助项目“墨家‘兼爱’法思想的现代诠释”（15FFX020）；厦门大学校长基金项目“墨家法律思想及其现代价值研究”。
