英文摘要	云计算技术的发展带来了著作权法适用的新问题。通过云计算利用作品的行为与出租行为具有相似性,但出租权系作为发行权一部分或子权利而存在的,选择出租权规制云计算传播行为,即是选择以发行权体系进行规制。中国已选择了以向公众传播权体系规制交互式网络传播行为的逻辑。云计算传播行为应被包含在交互式网络传播行为之内,因此选择发行权体系进行规制是与既有逻辑相矛盾的,云计算传播行为仍应以信息网络传播权进行规制。; The development of cloud computing has brought new challenges to the enforcement of copyright law.Providing works through cloud computing has some similarities with leasing works,but the right of lease is not appropriate to regulate the former act.The right of lease plays a role as a part of right of distribution or as a subsidiary right of it.If the act of providing works through cloud computing is regulated under the right of lease,it is substantially regulated under the system of right of distribution.China has chosen the system of right of communication to the public to regulate interactive communication of work through network.Consequently,it is contradictory to regulate the act of providing works through cloud computing under the system of right of distribution,as providing works through cloud computing has little differences from providing works through network.The act of providing works through cloud computing should be regulated under the right of communication through information network.; 厦门大学研究生基础创新科研基金项目“智慧城市法律治理研究——以厦门为重点研究个案”(201322G008)
