| 英文摘要 | 随着航运业与石油开发产业的日益推进与发展，伴随而来的海上石油污染风险亦日益提升。以“损害移转”为中心的传统损害赔偿体系逐渐无法适应油污所造成的大规模侵权损害，故以“损害分散”为中心的救助体系应运而生。油污责任基金作为“损害分散”救助体系之极为重要的一员，以其特有的优势有效弥补油污受害人所受损害、有效激励清污者行动，从而在保护海洋环境、维护受害人应有权益方面起到极其重要的作用。美国作为世界上最大的石油进口国之一，对于油污损害赔偿之法律规制亦极其严格，尤以1990年油污法即OPA90为最明显。而美国油污责任信托基金亦以其长久以来应对油污事故的有效性而出众于世。因此，本文从油污责任基金制度及其法理的...; With the promotion and development of shipping industry and petroleum exploitation industry, the oil pollution risk rises substantially.
