| 英文摘要 | 汽车时代的来临，由于严重超速驾驶行为造成的恶性交通事故呈较为高 发的趋势。《刑法修正案（九）》在增设危险驾驶罪的基础上，进一步丰富 了危险驾驶行为的种类。这表明实践中，单单依靠行政手段已经难以遏制诸 多种类危险驾驶行为导致的高发事故，需要将严重超速驾驶行为纳入危险驾 驶罪。但是受到刑法谦抑性原则的约束，讨论一个行为的犯罪化应当充分考 虑其侵害法益的可能性和严重性，必须进行立法证成。并通过分析严重超速 驾驶行为入罪后的构成要素，试图在危险驾驶罪的罪状描述和刑罚配置上提出建议。 本文共分为四个章节，第一章阐述严重超速驾驶行为纳入危险驾驶罪的 必要性。分别从理论基础、现实背景、权利保...; With coming of the automobile era, the vicious traffic accidents caused by serious excessive speeding showed a trend of high incidence.
