| 英文摘要 | 海洋环境与人类的生存发展息息相关，为了保护海洋环境，我国一面积极地参加国际公约，一面与时俱进地优化国内立法，以期更有效地防止和处理污染。船舶碰撞引起的油污对海洋环境造成的危害不容小视，当前我国并未出台专项的油污立法，油污问题的法律规定并不完善，司法实践中出现了同类案件不同裁判结果的现象。其中争议最多、法律适用最混乱的就属船舶碰撞油污损害赔偿案件中非漏油方的责任承担问题。学术界对此有三种观点：漏油方先行承担赔偿责任；非漏油方与漏油方按碰撞过失比例承担按份责任；非漏油方与漏油方承担连带责任。最新颁布的最高人民法院《关于审理船舶油污损害赔偿纠纷案件若干问题的规定》（以下简称《船舶油污损害赔偿规定》）...; The marine environment and human survival and development are closely related, in order to protect the marine environment, our country actively participated in the conventions, on the other side keep pace with the times to optimize the domestic legislation, in order to more effectively prevent and deal with pollution.
