| 英文摘要 | 保险代位求偿权，作为法律赋予保险人的一种特殊权利，既可以使被保险人在遭受保险事故后能尽快得到补偿，又可避免其获得不当得利的可能；既能保证保险人在此种情况下不会因为支付了赔偿而减弱其经济实力、降低其经济补偿能力，从而保障保险人的权益，又使有过错的第三者不能因为有保险人的赔付而推卸自己应当承担的责任，具有极其重要的意义。为此笔者以民商法的基本理论为基础，结合我国现行立法中关于保险代位求偿权的规定，并借鉴其他国家的最新研究成果，对保险代位求偿权的基本理论、与相关概念的比较、行使的规制等相关问题进行分析和研究，力图寻求出完善我国保险代位求偿权的最佳选择方案，全文分为引言、主文、结语三部分，其中主文部分...; Right of insurance subrogation, as a special right endowed by law,has significant meaning.
