| 英文摘要 | 海上石油工业不断从浅滩走向深海，海上溢油风险亦随之增大。触目惊心的溢油事故对海洋生态环境造成了灾难性的后果，由此，海上钻井平台作为海上石油工业的核心而备受关注。然而，当下学界在研究视野上难以突破，现行法律在概念界定上莫衷一是，司法实务界在裁决标准上难以统一，这些都导致海上钻井平台法律属性难以确定，并直接阻碍了海上油污立法的统一进程。相较于国际社会积极的立法尝试和国外相对成熟的油污治理实践，我国均难以望其项背。在2011年渤海湾油污事故教训之下，我国立法应打破“重船舶、轻平台”的局面，推动制定一部统一的以船舶和海上钻井平台为规制客体的油污法。 本文以海上钻井平台的法律属性之争作为切入点，厘定海...; Offshore oil industry constantly moves from shoal to deep ocean, the risk of oil spill also increases.
