| 英文摘要 | 法定代理制度的功能旨在补充被代理人的法律行为能力之不足,以维护被代理人的合法权益。传统的代理行为效力归属原则的构建基础乃意定代理,随着保护未成年人和精神障碍者成为现代法律体系的一项基本任务,其在法定代理领域的局限性开始凸显,由此拉开了对传统的法定代理制度进行改革的序幕。我国《民法通则》未对法定代理权的范围、行使及其监督等问题做出详细规定,在理论和实践中存在诸多不足,应在充分借鉴域外先进经验的基础上,对法定代理人违约后的法律效果等问题展开理论反思和规范重构。; The function of statutory agency is to supplement the deficiency of principle's capacity for civil conduct,so the principal's legal rights and interests can be protected.As protecting the minors and mental disordered person becomes a fundamental duty in legal system,the disadvantages of traditional acts of agency's attribution which is based on the agency by conduct have emerged in the field of statutory agency; as a result,the conventional legal system of statutory agency is experiencing reform.General Principles of the Civil Law of PRC has not stipulated the statutory power of agency 's scope,exercising,as well as supervision.So,a lot of drawbacks have exposed on the field of theory and practice.In order to eliminate such disadvantages,we should introspect and reconstruct the legal consequence of statutory agent 's contract breaking,by drawing lessons from other countries.; 福建省社会科学规划项目“侵权责任能力制度原理及功能研究”;项目编号:2014C140; 中央高校基本科研业务费项目“法典化背景下民事行为能力制度立法研究”;项目编号:T2013221005 |
