中文摘要中国房地产业宏观调控从未达到控制房价快速上涨的预期效果,因此应转变调控思路,研究建立房地产调控的长效机制。本文在检讨历次房地产调控手段失灵原因的基础上,提出长效机制的本质是制度改革。长效机制和法律有着内在的联系,在长效机制的建立过程中,法律应该起到重要作用。同时,探讨了如何建立房地产调控长效机制的具体法律路径。; Macro- control of real estate in China has never achieved its target,so long- term macro-control mechanism should be set up. This paper examines the causes of failure and proposes that long-term mechanism is the reform of system. Long- term mechanism and law have inner connection,and law should play its role in the construction of this mechanism. In the meantime,the legal approach to how to set up a long- term mechanism is discussed.
